1. Acceptance of Terms

By accessing or using RealEstateDesk.AI ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Service.

2. Service Description

RealEstateDesk.AI provides AI-powered audit, analytics, customer relationship management, and messaging tools for real estate teams and brokerages. Our services include automated analysis of publicly available online data, report generation, AI content creation, lead response automation, CRM, and review management.

3. Platform Messaging — RealEstateDesk Account and Authentication Messaging (Part A)

This Part A applies to SMS and MMS messages that RealEstateDesk.AI sends directly to you as a platform user. These messages include one-time login passcodes and account-security alerts. For these messages, RealEstateDesk.AI is the sender.

Consent. When you create or sign in to your RealEstateDesk account and provide a mobile number, you consent to receive authentication and account messages at that number. Consent is requested at the point of phone-number capture and recorded together with the timestamp and the form of consent.

Permitted content. Messages under this Part A are limited to authentication codes and account-security notifications (such as new-device sign-in alerts). RealEstateDesk.AI does not send promotional or marketing content under this program.

Opt-out. You may opt out of non-essential Program A messaging at any time by replying STOP (or any standard opt-out keyword) or by communicating revocation to RealEstateDesk.AI by any other reasonable method. Opting out of authentication messages may prevent you from signing in to your account and may require an alternative authentication path.

Message and data rates. Standard message and data rates may apply.

Message frequency. Message frequency varies by your account activity.

Carriers not liable. Carriers are not liable for delayed or undelivered messages.

Customer care. For questions about messages you receive under this program, contact RealEstateDesk.AI support at support@realestatedesk.ai, monitored Monday–Friday, 9am–5pm Mountain Time. Replying HELP to any message will return the same contact information.

4. Platform Messaging — Messaging to Your Contacts (Part B)

This Part B applies to SMS and MMS messages that you send or configure to be sent from your RealEstateDesk account to your own leads, borrowers, partners, or other business contacts ("Contacts"). For these messages, you are the sender for purposes of applicable law, carrier rules, and regulatory oversight. RealEstateDesk.AI provides the software and communications infrastructure.

Your consent obligations. You are solely responsible for obtaining and maintaining lawful consent from each Contact to whom you send SMS or MMS through the platform. This includes, where applicable, express written consent for messages that constitute telemarketing or promotional content under the Telephone Consumer Protection Act (TCPA), and any additional state-law consent required. You represent and warrant that every phone number you upload, import, or record in RealEstateDesk is a number for which you hold the consent required by law to send the type of message you intend to send, and that you can produce evidence of that consent on reasonable request.

Permitted use. You may use the platform messaging tools to communicate with your Contacts for lawful, licensed, and consented communications within your authorized business activities, including responding to inbound leads, confirming and reminding about appointments, following up on applications and documentation, and delivering transactional information related to the Contact's engagement with you.

Prohibited use. You may not use the platform to:

  • Send messages to phone numbers for which you do not hold valid, documented consent
  • Send messages using purchased, rented, scraped, or otherwise non-consented contact lists
  • Send unsolicited promotional or marketing messages to Contacts who have not given the consent required for that type of message
  • Send content that is misleading, deceptive, harassing, or unlawful
  • Send content prohibited by carrier rules, aggregator rules, or applicable law
  • Attempt to evade opt-out requests, carrier filtering, or aggregator compliance controls
  • Impersonate any person, entity, lender, or agency you are not authorized to represent

Opt-out handling. The platform automatically processes standard opt-out keywords (STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT) on your behalf and suppresses further non-essential messaging to any Contact that opts out. You are also obligated to honor opt-outs communicated by any other reasonable method (including verbal requests, email, or written communication). You may not override, circumvent, or delay opt-out suppression. You may not re-contact an opted-out Contact through the platform using a different number or identity to re-solicit consent without an independent, lawful basis for doing so.

Platform rights. RealEstateDesk.AI may, at its discretion and with or without prior notice, suspend or terminate messaging access, remove content, throttle sending, or terminate your account if we reasonably determine that you are violating these terms, applicable law, carrier rules, or our acceptable use standards. We may cooperate with carriers, aggregators, and regulators in connection with abuse investigations and compliance reviews.

TCPA, FCC, and carrier rule compliance. You agree to comply with the Telephone Consumer Protection Act; applicable Federal Communications Commission rules including those governing consent, revocation, and robocall/robotext handling; the CAN-SPAM Act; CTIA Messaging Principles and Best Practices; all applicable state telemarketing and consumer-protection laws; and the published rules of the carriers and aggregators through which your messages are delivered. You are responsible for determining which of these rules apply to your messaging and for operating accordingly.

Indemnification. You agree to indemnify and hold harmless RealEstateDesk.AI, its affiliates, and its communications providers from any claim, loss, or liability arising from your violation of consent obligations, applicable law, or carrier rules in your use of the platform messaging tools.

5. User Responsibilities

  • You must provide accurate and complete information when using our services
  • You are responsible for maintaining the confidentiality of your account
  • You agree not to use the Service for any unlawful purpose
  • You agree not to scrape, reverse-engineer, or misuse the Service

6. AI-Generated Content Disclaimer

Our reports and analyses are generated using artificial intelligence. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. Our reports are intended for informational purposes only and should not be considered legal, financial, or professional advice. You should independently verify any information before making business decisions based on our reports.

7. Intellectual Property

The Service, including its design, features, and content, is owned by RealEstateDesk.AI and protected by intellectual property laws. Your audit reports are generated for your use, but the underlying technology, algorithms, and platform remain our property.

8. Limitation of Liability

To the maximum extent permitted by law, RealEstateDesk.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the revised Terms on this page. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to conflict of law principles.
